Terms & Conditions

Last updated: 20.01.2026

These Terms & Conditions (“Terms”) apply to all purchases and use of this website [your domain] (the “Site”) and any orders placed through it.

1) About us

This Site is operated by:

Hristina Micevska e.U. (Brand: BYHR / BYHR Beauty)

Hasibederstraße 21/25, AT-1220 Vienna, Austria

Email: office@fleurdemode.com

VAT ID: ATU70220548

2) Scope & definitions

  • “You” means any visitor or customer.
  • If you are a consumer, mandatory consumer protection laws apply and nothing in these Terms limits your statutory rights.

3) Products

We sell haircare/beauty products and related accessories. Product descriptions, images, and ingredient information are provided for convenience and may vary slightly (e.g., due to lighting or packaging updates). We reserve the right to improve or modify products without affecting existing orders.

4) Orders & contract conclusion

  • By placing an order, you make a binding offer to purchase the selected products.
  • A contract is formed once we confirm your order by email and/or dispatch your products (whichever occurs first).
  • We may refuse or cancel orders in cases such as suspected fraud, incorrect pricing, or stock issues (in which case we will refund any payment received).

5) Prices, taxes & payment

  • All prices are shown on the Site in [EUR] and include/exclude VAT depending on your setup. Any applicable shipping costs are shown at checkout.
  • We accept the payment methods displayed at checkout (processed by payment providers). We do not store full payment card details.

6) Shipping, delivery & risk

Shipping regions, delivery estimates, and shipping fees are described on our Shipping & Returns page and/or at checkout.

  • We dispatch orders on business days (unless stated otherwise on the Shipping page).
  • Delivery timelines are estimates and may vary during peak periods.
  • Once your parcel is handed over to the carrier, delivery is performed by the carrier under their conditions.

7) Right of withdrawal (consumers) & returns

If you are a consumer in the EU/EEA/UK, you generally have the right to withdraw from a distance contract within 14 days, subject to legal exceptions.

Your withdrawal instructions, return conditions, and the model withdrawal form are available on our Shipping & Returns page (which forms part of these Terms). Please read that page carefully before ordering.

Important: For hygiene reasons, certain products may be excluded from withdrawal if they are sealed and the seal has been removed after delivery (where applicable under consumer law). (If you use seals, make sure you actually seal those items.)

8) Damaged, incomplete, or missing orders

If your order arrives damaged or incomplete, please contact us within the timeframe stated on our Shipping & Returns page and include photos of the shipping box and products so we can assist.

9) Statutory warranty (Gewährleistung) & guarantees

You have statutory warranty rights for defective goods under applicable law. Warranty is different from a commercial guarantee; any additional guarantee will be stated explicitly if offered.

10) Liability

To the extent permitted by law:

  • We are not liable for indirect or consequential damages.
  • Nothing in these Terms excludes liability for intent, gross negligence, personal injury, or any liability that cannot be excluded under mandatory law.

11) Intellectual property

All content on the Site (including brand names, texts, photos, videos, graphics, and designs) is owned by or licensed to BYHR and may not be used without prior written permission.

12) User content (reviews, comments)

If you submit reviews or content, you grant us a non-exclusive right to use it for marketing and communication purposes (e.g., on the Site or social media), unless you ask us not to.

13) Privacy & cookies

Our processing of personal data is described in our Privacy Policy and Cookie Policy.

14) Alternative dispute resolution (ADR)

Consumers in Austria may be able to use recognised out-of-court dispute resolution bodies. For online shopping disputes, relevant bodies can include “Schlichtung für Verbrauchergeschäfte” and the Internet Ombudsstelle.

We are not obliged to participate in ADR proceedings unless required by law, but we always aim to resolve concerns directly and fairly.

Note: The EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025.

15) Governing law & jurisdiction

These Terms are governed by Austrian law, excluding its conflict-of-law rules. If you are a consumer, this does not deprive you of mandatory protections under the laws of your country of residence. Disputes may be brought before the competent courts.

16) Changes to these Terms

We may update these Terms from time to time. The version published on the Site at the time of your order applies.

17) Severability

If any provision of these Terms is found invalid, the remaining provisions remain in effect.
